General terms of sale

1. PREAMBLE

These General Terms and Conditions of Sale apply to all commercial transactions concerning items put up for sale by Brussels Vintage Guitars on its website, to the exclusion of all other conditions (unless expressly waived in writing and mutually approved by the parties ). The mere fact of placing an order through the vector of the website www.brusselsvintageguitars.com entails acceptance of the general conditions reproduced below.

2. DEFINITIONS

The terms used in these general conditions or on the Brussels Vintage Guitars website must be understood as follows:

 

2.1. Brussels Vintage Guitars: the website of Brussels Vintage Guitars on which the Products are presented and sold to customers.

2.2. Customer: any natural or legal person, legally capable, who places an order for product(s) at Brussels Vintage Guitars.

2.3. Order: request for conclusion of a sales contract by the customer between Brussels Vintage Guitars and the customer of Brussels Vintage Guitars concerning the products presented by Brussels Vintage Guitars.

2.4. Product sheet: refers to the information (text, photos, graphics, classification system by section, etc.) related to a product offered for sale on the Brussels Vintage Guitars website.

2.5. Products: all the goods offered for sale by Brussels Vintage Guitars through the vector of its website.

2.6. Transaction: all operations, secure processing, authorizations and agreements inherent in the payment of products ordered by bank card or any other means of virtual transaction offered on the site.

3. ACCEPTANCE OF TERMS

The customer acknowledges having read these general conditions of sale and declares, by placing the order, expressly accepting them without reservation. The validation of the order implies acceptance of the general conditions of sale.

4. PURPOSE

Brussels Vintage Guitars offers the products for sale online (article 5). The customer connects to the website and places an order for the products he has chosen by browsing the site via email (article 6). The products purchased are paid for online using one of the solutions offered on the site (article 8). Brussels Vintage Guitars confirms the acceptance of the order by e-mail and the products are delivered to the customer within a specified period (article 7).

5. PRODUCTS

​Only products for which a “product sheet” is published on the Brussels Vintage Guitars website can be sold.

6. ORDERS

6.1. All the information provided by the customer, when encoding the data inherent in his order, is binding on him. Brussels Vintage Guitars can in no way be held responsible for errors made by the customer in the wording of the contact details of the recipient of the order (delivery address, invoicing address in particular) and for delays in delivery or the impossibility of delivering the products ordered that these errors could cause.

6.2. Upon receipt of his order request, Brussels Vintage Guitars confirms to the customer the acceptance of his order by sending a confirmation message to the e-mail address that the latter communicated when registering his order. The sale will not be concluded until the said order confirmation has been sent.

6.3. In general and without any necessary justification, Brussels Vintage Guitars reserves the right to refuse or cancel any order from a customer, in particular in the event of a payment problem for the order concerned or a dispute relating to the payment of a previous order or when the product in question is no longer available, or simply because of a simple material error on the site. If a purchase is unsuccessful, no compensation can be claimed from Brussels Vintage Guitars.

6.4. Only legally capable persons can place an order.

7. DELIVERY

7.1. After confirmation of the order and acceptance of payment by the organization in charge of the transaction, Brussels Vintage Guitars undertakes to prepare the shipment to the customer of the products ordered at the delivery address mentioned within a period generally between 1 and 3 working days depending on the destination. Brussels Vintage Guitars cannot be held responsible for delays attributable to the shipping company.

7.2. By placing an order, the customer agrees to pay upon receipt of the goods, all taxes, duties, taxes and other present and future charges due for the delivery of the ordered products. The responsibility of Brussels Vintage Guitars  will in no way be engaged in this respect.

7.3. The delivery is made by international registered post or by UPS/FEDEX/DHL at the customer's choice, the delivery rates and deadlines will be communicated by email. No compensation can be claimed from Brussels Vintage Guitars by the customer in the event of late delivery.

7.4. Upon receipt of the products ordered, the customer or the recipient must check the good condition of the product delivered. In the event that one or more of the products ordered are missing or damaged, the customer or the recipient must immediately make the necessary reservations to the carrier at the time of delivery.

8. TRANSPORT AND INSURANCE

In general, the risk of transport is borne by the customer, the responsibility of Brussels Vintage Guitars being limited to the preparation of the shipment according to the rules of the art and the delivery of the package to the shipping company according to the instructions and addresses provided by the customer. At the customer's express request, Brussels Vintage Guitars can take out insurance covering the risk of loss/theft on their behalf, the cost of this insurance varies between 1 and 1.5% of the value provided depending on the destination. In the event of a claim, Brussels Vintage Guitars will reimburse the customer only within the time limit and the extent of the compensation ultimately granted by the insurance, if the insurance refuses to compensate the claim, Brussels Vintage Guitars will subrogate the Customer in his rights. vis-à-vis the company so that the Customer can act as he pleases towards it, it being understood that the responsibility of Brussels Vintage Guitars is strictly limited to having the package insured as a good father on behalf of the Customer.

9. PRICE

9.1. The price indicated on the product sheets does not include costs related to transport and/or transport insurance.

9.2. The price indicated in the order confirmation is the final price expressed all taxes included and including VAT (on the margin or in full depending on the type of product).

10. PAYMENT

10.1. The price of the products is payable in cash by one of the means of payment offered on the site on the day the order is placed.

10.2. The order validated by the customer becomes effective only when the bank payment center has given its agreement to the execution of the transaction. In the event of refusal by the bank payment center, the order will be automatically canceled and the customer notified by e-mail.

11. DELIVERY

The delivery (and therefore the acceptance of its conformity) takes place either (i) by the delivery of the object in store or (ii) by the acceptance of the package from the carrier (signature).

The buyer has a 14-day right of withdrawal in accordance with the conditions set by DIRECTIVE 2011/83/EU on consumer protection.

In the event of withdrawal, Brussels Vintage Guitars will reimburse the sale price of the instrument excluding any shipping/insurance costs (outward and return) and any commission levied by the payment organization that processed the transaction. .

In addition, this right of withdrawal can only apply if the object is returned in its pristine condition, both cosmetic and functional, the photos on the site being authentic.

12. RESPONSABILITY

12.1. Brussels Vintage Guitars cannot under any circumstances and in any way be held liable for damages of any kind that may result from improper use of the products marketed.

12.2. The responsibility of Brussels Vintage Guitars, cannot likewise be sought for possible modifications of the products which would be the fact of the manufacturers.

12.3. The liability of Brussels Vintage Guitars will, in any case, be limited to the amount of the order and cannot be blamed for simple errors or omissions which may have remained despite all the precautions taken in the presentation of the products. In particular, the photos on the site are provided for information purposes. Under no circumstances can a modification of the container or content of a product be invoked in the event of a discrepancy with the photo available on the site.

12.4. This site contains links to other Internet sites. Brussels Vintage Guitars cannot be held responsible for the current or future content of these sites, nor for the content of external sites that have a link to the Brussels Vintage Guitars site.

13. WARRANTY

​13.1 Under no circumstances can Brussels Vintage Guitars be held responsible for non-compliance with the regulations and laws in force in the country of receipt. The potential liability of Brussels Vintage Guitars is exclusively limited to the value of the product in question, determined on the date of its sale. The customer may contact customer service by completing the form available on the Brussels Vintage Guitars website under the 'Contact' section.

14. PERSONAL DATA

14.1. The collection of personal information carried out for the purposes of distance selling is mandatory, this information being essential for the processing and delivery of orders. The lack of information leads to the non-validation of the order.

14.2. Brussels Vintage Guitars respects the Belgian law of December 8, 1992 in relation to the processing of personal data, revised by the law of December 11, 1998, which takes into account the European directives of October 24, 1995. This law provides that the company which brings together personal data must have the consent of the person concerned, that the data must prove to be accurate and that they must be collected for a specific, clear and legal purpose. Everyone must have access to this personal data and the right to be able to modify it. In accordance with the law, the processing of personal information relating to customers has been declared to the Commission for the protection of privacy. The customer has a right to access, modify, rectify and delete data concerning him, which he can exercise with Brussels Vintage Guitars.

14.3. Brussels Vintage Guitars undertakes never to communicate the details of its customers to a third party.

15. INTELLECTUAL PROPERTY

​The texts, layouts, illustrations, photos, product sheets and other elements appearing on this site are protected by copyright and, in general, by the principles of intellectual property law. The content of the Brussels Vintage Guitars site may not be copied. It may not be modified, placed on another site or published in any form without the prior written authorization of Brussels Vintage Guitars. This site may also contain texts, illustrations and other elements protected by the copyrights of third parties. Brussels Vintage Guitars does not give in any way and in any case the authorization to use their intellectual property, nor that of third parties.

16. DISPUTE AND APPLICABLE LAW

In case of difficulties in the application of this contract, the customer and Brussels Vintage Guitars reserve the possibility, before any legal action, to seek an amicable solution. Failing this, the courts of Brussels, French-speaking section, are competent, regardless of the place of delivery of the products or the domicile of the customer. Contracts and all legal relationships between the customer and Brussels Vintage Guitars are subject to Belgian law.
